Poll favouritism: SHC moved against SP Larkana, SHO

LARKANA: Contempt of Court application has been filed by advocate Qadir Bus Bhatti through his lawyer Habibullah G. Ghouri in the Sindh High Court Circuit Court, Larkana, under Article 204 of the Constitution against contemnors SHO Haideri police station and Kamran Nawaz Panjota, Senior Superintendent of Police Larkana.

The petitioner stated that he filed a petition before this court which was finally heard & decided at the undertaking of Additional Advocate General that all the government functionary including the respondents being law enforcing agency shall provide protection to the contesting candidates during local bodies election process and they act strictly in accordance with law to maintain law & order situation particularly on the poll day but instead of providing protection to all the candidates contesting elections, they only provided the protection to the candidates of ruling party by providing them the police mobiles, police personnel and contingencies along with the weapons and ammunition to help and support them only.

The petitioner further stated that their police officials were seen forcing the electorate to cast vote in favour of ruling party only and they were also seen snatching ballots and affixing in the stamps in favour of the ruling party candidates. Facing the situation, the petitioner further stated that the candidates of petitioner’s party raised alarm and approached the respondent to implement the order dated 15th October in letter & spirit but rather the complainant and their subordinate police officials remained harassing the opponent candidates to the ruling party in Larkana and their voters. Thus the contemnors named above refused point-blank to implement the order passed by this court hence non-compliance is clear defiance and their refusal to implement the order is clear contempt of court.

In their order dated 15th October, 2015, Justices Salahuddin Panhwar and Syed Saeeduddin Nasir had directed the respondents in CP No:1124 to provide complete protection to the petitioner and other candidates, who are contesting election in the area of Larkana division and all government functionaries will act strictly in accordance with law & they will take all steps to maintain the law & order situation in election process, particularly on poll day and undertaking of AAG is satisfied and seeks disposal of the petition. The application will be heard on 05th November. .
