SHC restricts govt issuing final appointment orders of police constables

Karachi: The Sindh High Court SHC on the Tuesday restricted the Sindh government from issuing final appointment orders to police constables, as per impugned advertisement dated December 9, 2012 without permission of court.

This order came on petition filed by Waseem Khan and 25 others who had applied for the post of police constable. They cited province of Sindh through chief secretary, home department, deputy inspector general of police and superintendent of police, west zone as respondents.

The petitioners submitted that they had applied for the post of the police constable BPS5 following the vacancy advertisement given by police department on February 14, 2012 in various newspapers.

They stated that they had presented all the required documents along with required educational testimonials and after the submission of documents, the same were thoroughly examined by the concerned zonal officers for their utmost satisfaction and later they were allotted the candidate file numbers.

They stated before the court that they remained successful in all tests and qualified for the post of police constable in BPS05, adding that they were waiting for the announcement of the results publically but till today the results have not been announced.

They submitted that appointment orders were issued to the candidates who had either failed in the test or they had even not applied for the post.

Petitioners submitted that all of sudden police department have issued advertisement in the newspaper on December 9 2012 for post of the police constable, which they claimed that is illegal as they had already qualified for the post but deprived of appointment orders.

They prayed to court to suspend the recruitment orders on the basis of advertisement published on December 9, 2012 and direct the respondents to recruit the petitioners if they fall eligible for the post on merit.

They also prayed the court to direct the respondents to place the record of the recruitment of the police constable following the advertisement given earlier in the newspapers.

The Division bench comprising Justice Munib Akhtar and Justice Muhammad Shafi Siddiqui issued notice to respondents as well as additional advocate general.

The court ordered, “Till the next date the recruitment process as per impugned advertisement dated December 9, 2012 may be continued but such process shall remain subject to such orders as may be this court in this petition and no final appointments orders shall, in any be issued without the permission of the court”.

Hearing of the case was adjourned till 1812013.
