Karachi: The Sindh High Court SHC on Wednesday ordered the in person appearance of the station house officer of Kalakot police station to explain why court orders pertaining to lodge an FIR against former Sindh home minister Zulfiqar Mirza if recognizable offence of blasphemy is made by him has not been complied with.
This order came on a contempt of court application filed by former Sindh Minister for Industries Abdul Rauf Siddiqui. He had earlier moved the court for seeking its directives to respondents for registering of an FIR against former Sindh home minister Zulfiqar Mirza on alleged charges of blasphemy.
The applicant cited Javed Baloch, SHO Kalakot police station and Deputy Inspector General of police South as respondents.
The counsel for the applicant submitted that this court earlier has passed orders dated December 7, 2012 whereby the SHO has been directed to record the is made out under Section 295C of Pakistan Penal Code, adding he shall incorporate the same in accordance with the Section 154 Cr.P.C for further proceeding in accordance with law.
He submitted that despite approach of the applicant the SHO concerned has failed to perform his statutory duty and failed to comply with the court orders.
He submitted that applicant approached to the concerned SHO with his written statement but after long wait, the SHO refused to lodge the FIR and such is liable to be punished.
He prayed to court to issue notice of contempt of this court to contemnors and punish them according to law as the contemnors have intentionally disobeyed the court orders.
The single bench comprising of Justice Naematullah Phulpoto ordered, “SHO Kalakot police station is directed to appear in person and to show as why court orders dated December 7, 2012 has not been complied with.”
The hearing has been adjourned till January 4.
