Karachi: Sindh High Court (SHC) on Tuesday took up another appeal challenging the order of its single bench pertaining to the dispute over payment of salary to Karachi Metropolitan Corporation (KMC) administrator Rauf Akhtar Farooqui and issued notice to provincial authorities to file comments on the appeal by July 04.
Mumtaz Haider, 19-grade officer in local government department, challenged an order issued by a single bench of SHC that directed SBCA to continue paying salary to the KMC administrator and dismissed his application seeking to join the proceedings in the matter pertaining to the salary of KMC administrator.
Appellant’s counsel stated that KMC administrator had joined SBCA as assistant controller of building (grade-17) in 1979 and submitted official documents including NIC, domicile and other certificates mentioning date of birth ‘October 10, 1952’. He claimed that Farooqui got his date of birth changed by then Karachi Mayor on basis of certificate of domicile issued to him illegally by city administration of Dera Gazi Khan.
Issue regarding his date of birth had already been challenged in SHC through a constitutional petition which was pending disposal, he said while adding that when SBCA authorities came to know the controversy, they sent a letter to Board of Intermediate Education for verification of the date of birth of KMC administrator and subsequently it was verified that he was born in 1952.
Counsel said, though, he was an employee of SBCA but he had been appointed as KMC administrator on deputation in violation of apex court’s verdict regarding deputation and added that this had affected badly the promotion of his client. He said that according to date of birth mentioned on his official documents, he was to retire on October 25, 2012, but he was still continuing his service and drawing salaries even after his retirement date.
SBCA authorities stopped the salary of KMC administrator on April 30, 2014 after it knew about the retirement of KMC administrator. Later, he filed a lawsuit against this SBCA’s decision and his lawsuit was allowed with direction to SBCA to continue paying salary to KMC administrator.
Such order passed by a single bench was illegal as it was passed without giving opportunity of hearing, he argued and requested the court to set aside such order.
