KARACHI: The Sindh High Court (SHC) on Wednesday restrained director Air Force Officer Housing Scheme (AFOHS) from carrying out construction of a private bank on an amenity plot in PAF Falcon Complex at Shaheed-e-Millat Road in Karachi.
Justice Shafi Siddiqui, who headed a single bench, gave this interim order on a lawsuit filed by Jamshed Chandiwala and other residents of Falcon Complex, who have taken AFOHS and other defendants to the court against illegal construction of a structure on amenity plot in complex reserved for parks, jogging tracks, parking and other amenities.
The judge issued a notice to defendants – director AFOHS, assistant director AFOHS, military land and cantonments, military estate officer and Faisal Cantonment Board for filing comments.
Plaintiffs submitted in a lawsuit that original master plan of the PAF Falcon Complex was approved in 1998 and they and other residents purchased the plots in consideration of amenity plots available in the complex as per approved master plan.
They said that defendants AFOHS without having authority and amendment in the master plan have converted some amenity plots into commercial. One of the amenity plots had been allotted to a private bank for construction of its branch in the society.
If such construction is allowed it would be sheer violation of approved plan, the plaintiff said while requesting the court to restrain defendants from raising any such construction on amenity plot. Hearing of case was adjourned till April 16.
