KARACHI: Sindh High Court (SHC) on Thursday directed Election Commission of Pakistan to file comments on two identical petitions filed by the presiding officers of Karachi and Sukkur election tribunals against ECP for withholding their judicial allowances.
A division bench, headed by Justice Munib Akhtar, directed ECP’s law officer to show up before court at the next hearing along with the relevant record. The court adjourned the hearing till May 14.
The contract period of Zaheeruddin Leghari, the presiding officer of Sukkur election tribunal and Dr Zafar Ahmed Sherwani Karachi election tribunal expired on June 30, 2014 and on February 28, 2015, respectively.
The petitioners submitted that they were appointed as heads of the election tribunals on contract basis by ECP vide notification issued on May 28, 2013, on the recommendation of SHC Chief Justice on the same pay, perks and privileges given to BS-22 serving officer.
They were entitled to special judicial allowance equal to thrice the initial of the substantive pay scale but ECP illegally directed the AGPR to withhold the judicial allowance. Therefore, they requested the court to direct ECP to make payment of allowances and other service benefits.
