KARACHI: The Sindh High Court on Tuesday summoned comments from the federal and provincial authorities on a petition seeking the release of Moazzam Ali Khan, a prime suspect behind the murder of Muttahida Qaumi Movement leader Dr Imran Farooq.
A division bench headed by Justice Mohammad Ali Mazhar issued notice to the federal and provincial law officers to file comments of the authorities till July 16.
The bench had taken up the petition filed by Sadia Bano, the wife of the suspect, against detention of her spouse.
On Tuesday, the petitioner filed a miscellaneous application, submitting that her husband was arrested on April 12 by the paramilitary troops, who had placed him under 90-day preventive detention for questioning under Section 11EEEE (1) of the Anti-Terrorism Act of 1997.
The petitioner’s counsel told the judges that his detention period had ended on July 13; however, till date neither did the Rangers release him nor produce him before the anti-terrorism court. He argued that he was kept in illegal detention by the paramilitary force in violation of the fundamental rights.
The woman petitioner pleaded with the judges to order the Rangers to produce her spouse in court. The court was prayed to order the release of the suspect on bail.
Earlier in the main petition, Bano had submitted that the personnel of the paramilitary force raided her house in Federal B Area’s Block 8, Azizabad, in the early hours of April 12 and took away her husband and his belongings, including a laptop.
