Illegal encroachments beneath flyover: SHC summons KMC administrator


KARACHI: The Sindh High Court (SHC) has been informed that additional director enforcement and encroachment at Karachi Metropolitan Corporation (KMC) was suspended after he issued show-cause notice to Sindh Chief Minister’s son, who is managing director of a pharmaceutical company, for removing encroachment under the Shaheed-e-Millat flyover.

A division bench of SHC headed by Justice Sajjad Ali Shah issued notice to administrator Karachi Metropolitan Corporation (KMC) and senior director Human Resource Department, KMC to appear in court and explain why additional director enforcement and encroachment was suspended.

The applicant pharmaceutical company represented by Asim Mansoor Khan approached the court, submitting that company was granted licence to park vehicles under the Shaheed-e-Millat flyover and for that purpose they have raised construction for security and safety of vehicles parked under flyover. He contended that parking of the vehicles under the flyover was not commercial activity, therefore, removal of such temporary construction should be restrained.

However, the counsel Raja Qasit Nawaz Khan representing petitioner said that allowing applicant’s plea would mount to overturn the judgment regarding removal of encroachments under the flyovers, which had also been upheld by Supreme Court. He said that sufficient time was allowed to applicant for removing the encroachment beneath flyover. Hence he requested the court to dismiss the application as it did not require any consideration.

He informed the two-judge bench that additional director enforcement and encroachment, Karachi Metropolitan Corporation (KMC) was suspended after he issued show-cause notice to Sindh Chief Minister’s son, who is managing director of pharmaceutical company, for removing encroachment under the Baloch Colony flyover.

He said that additional director was put under suspension without following due process of law.

The bench, while dismissing the application, directed for removal of the encroachments through Nazir under flyover and also directed the police to provide assistance for complying with the court’s earlier order for removing encroachment under flyover.

Earlier the court had directed KMC to remove encroachments under flyovers throughout the city, particularly under the Baloch Colony flyover (Shaheed-e-Millat flyover), within a month.

Hearing of case was adjourned to January 01, 2014.
