Master layout plan DHA Phase VIII revised in 2007: SHC told


KARACHI: Sindh High Court (SHC) was informed that Master layout plan DHA Phase VIII was revised in 2007 to meet increased demands for services and traffic. Counsel appearing on behalf of DHA provided this information to single bench of SHC comprising Justice Muhammad Shafi Siddiqui, who was hearing a lawsuit filed by Zahidullah Khan, a resident of DHA against DHA projects on amenity plots allocated for park, graveyard, school and sewerage treatment plant on Khayaban-e-Shaheen, in Phase VIII.

DHA’s counsel submitted in comments that Master layout plan DHA Phase VIII was prepared in early seventies and original plan was not sound urban planning. It was submitted that annual meeting of governing body of DHA had suggested the improvements in the master plan of Phase VIII and revised master plan was approved by body to cater to the increased demands for services and traffic.

Plaintiff’s counsel Salahuddin Ahmed said that DHA had launched projects in names of Creek Terraces and Creek View, Creek City in DHA, Phase-VIII on plots. The land where projects had been launched was actually amenity plots as per the Master layout plan but without permission of the federal government, DHA illegally granted permission to the defendants Creek Developers, BF Property and Construction Pakistan and AKD Capital Limited to launch aforesaid projects, he added.

The court was prayed to declare that initiation of projects on amenity plots allocated for park, graveyard, schools and sewerage treatment plant situated on Khayaban-e-Shaheen, Phase VIII, DHA, Karachi for commercial usage is unlawful and same cannot be used for any other purpose.

Earlier, plaintiff’s counsel filed an application, requesting the court to direct DHA to submit certain documents, including original lease pact dated November 11, 1975 executed in favour of DHA by the then president of Pakistan and original master plan of 1975, which showed original planning of phase-VIII DHA with all modifications and alterations.

While allowing the application of plaintiff’s counsel, the court had directed DHA to place before the court original lease agreement and original master plan of 1975, which showed the original planning of phase-VIII DHA with all modifications and alterations.

During the hearing, the bench directed DHA counsel to provide original master plan of Phase VIII to plaintiff’s counsel.
