SHC restrains police from harassing MQM workers

KARACHI: Sindh High Court (SHC) on Tuesday restrained Karachi police from indulging in any illegal activity and causing harassment to the workers of Muttahida Qaumi Movement (MQM).

A division bench headed by Chief Justice Maqbool Baqar was seized with the hearing of a petition filed by MQM against extrajudicial killings and torture of its members by law enforcement agencies. It directed police to act as per law and do not give any cause of complaint to petitioners or anybody else in the future.

The bench directed provincial health secretary to constitute a medical board comprising senior medical officers for conducting intensive medical examination of injured Fahad Aziz and submit comprehensive report regarding his state of health and injuries that he might have received from the alleged torture. The court also sought the daily policy diary record regarding arrest of Fahad Aziz.

The party through its leader Dr Farooq Sattar, MQM worker Fahad Aziz and his father jointly filed a petition, submitting that law enforcement agencies had unleashed a campaign of terror against urban citizens, especially MQM and its workers who were being targeted, adding that in past, about eight persons in Karachi had been killed extra-judicially, while about 45 persons were still missing.

Dr Farogh Naseem on behalf of the petitioners told two-judge bench that police picked up petitioner Fahad Aziz when he was on his route to his wedding, adding that he was detained by police who subjected him to torture and demanded gratification for his release.

He said that later Fahad was admitted to a hospital in Gulistan-e-Jauhar by SHO Shahrah-e-Faisal police station, who alleged that Fahad was hospitalized for having pain in stomach. He requested the court to order provincial authorities to pay compensation to victim and lodge FIR against police officials.

SSP East Pir Muhammad Shah told the court that Fahad Aziz along with driver were arrested by officials of Shah Faisal colony police station, when they received spy information about involvement of Fahad in heinous crimes including recent target killings of four policemen in Ibrahim Hyderi area.

He told the court that during interrogation Fahad also confessed to killing policemen. He said that due to his deteriorating health, he was hospitalized immediately. He said that interrogating team following reports of alleged torture of MQM worker was put under suspension and an inquiry was being carried out.

Hearing of case was put off till February 25.
