KMC administrator salary case: SHC issues notice to top officials


Karachi:,,, Sindh High Court (SHC) on Monday issued notice to secretary local government department and administrator Karachi Metropolitan Corporation (KMC) to submit their respective replies on an appeal filed by Sindh Building Control Authority (SBCA) challenging an order regarding payment of salary to KMC administrator.

SBCA through its director administration filed an appeal in SHC, challenging an order issued by a single bench of SHC that directed SBCA to release the salary of KMC administrator Rauf Akhtar Farooqi on June 11.

Appellant’s counsel stated that KMC administrator had joined SBCA as assistant controller of building (grade-17) in 1979 and submitted official documents including NIC, domicile and other certificates with date of birth ‘October 10, 1952’. He claimed that Farooqi got his date of birth changed by then Karachi Mayor on basis of certificate of domicile issued to him by city administration of Dera Gazi Khan.

Issue regarding his date of birth had already been challenged in SHC through a constitutional petition which was pending disposal, he said while adding that when SBCA authorities came to know the controversy, they sent a letter to Board of Intermediate Education in order to verify the date o f birth. Which was subsequently verified and showed that he was born in 1952.

Counsel said, though, he was an employee of SBCA but he had been appointed as KMC administrator on deputation in violation of apex court’s verdict regarding deputation. He said that according to date of birth mentioned on his official documents, he was to retire on October 25, 2012, but he was still continuing his service and drawing salaries even after his retirement date 18 months back.

SBCA authorities had stopped the salary of KMC administrator on April 30, 2014. Later, he filed a lawsuit against this SBCA’s decision. He said that his lawsuit was allowed and SBCA was directed to continue the salary of KMC administrator.

Such order passed by a single bench was illegal as it was passed without giving opportunity of hearing to SBCA, he argued and requested the court to set aside such order.
